Division I Proposal - 2021-32

ATHLETICS PERSONNEL -- ELIMINATION OF IN-PERSON SCOUTING PROHIBITION

Status: Defeated Final

Intent: To eliminate the prohibition on off-campus, in-person scouting of future opponents.

Bylaws: Amend 11.6, as follows:

11 Conduct and Employment of Athletics Personnel

[11.01 through 11.5 unchanged.]

11.6 Scouting of Opponents.

11.6.1 Off-Campus, In-Person Scouting Prohibition. Off-campus, in-person scouting of future opponents (in the same season) is prohibited, except as provided in Bylaws 11.6.1.1 and 11.6.1.2.

11.6.1.1 Exception -- Same Event at the Same Site. An institutional staff member may scout future opponents also participating in the same event at the same site.

11.6.1.2 Exception -- Conference or NCAA Championships. An institutional staff member may attend a contest in the institution's conference championship or an NCAA championship contest in which a future opponent participates (e.g., an opponent on the institution's spring nonchampionship-segment schedule participates in a fall conference or NCAA championship).

[11.7 renumbered as 11.6, unchanged.]

Effective Date:Immediate

Proposal Category: Amendment

Topical Area: Athletics Personnel

Rationale: The Board of Directors Infractions Process Committee requested that the Legislative Committee Modernization of the Rules Subcommittee focus its rules modernization efforts on identifying rules that no longer serve the needs of the membership and the 21st century student-athlete, and recommending modifications to or the elimination of such rules. Specifically, livestreams of intercollegiate competition and prerecorded game film are readily available in the digital age. The minimal competitive advantage gained by scouting future opponents in-person is outweighed by the monitoring and enforcement burdens of ensuring compliance with the legislation.

Estimated Budget Impact: Potential costs associated with in-person scouting.

Impact on Student-Athlete's Time (Academic and/or Athletics): None.
