SCOUTING OPPONENTS

Status: Adopted Final

Intent: In the sports of Division I men's and women's basketball and women's volleyball, to permit an institution, subsequent to the selection of the championship field until the conclusion of the championship, to purchase videotapes of opponents from individuals and/or professional scouting services.

Bylaws: Amend 11.6.1.1 by adding new 11.6.1.1.2, as follows:

"11.6.1.1.2  Purchasing Videotapes -- Postseason.  In the sports of Division I men's and women's basketball and women's volleyball, subsequent to the selection of the championship field until the conclusion of the championship, it shall be permissible to pay the costs of purchasing videotapes or films for scouting purposes from individuals or professional scouting services."

Rationale: When Bylaw 11.6.1.1 (1994 NCAA Convention Proposal No. 24) was adopted as a cost-savings measure to prohibit off-campus, in-person scouting of opponents in the sports of football and basketball, the legislation was silent on the ability to purchase videotapes for scouting purposes. During the discussion of Proposal No. 24 on the Convention floor, it was clarified that the legislation would also preclude an institution from employing or paying the expenses of someone else, including professional scouting services, to scout the opponent. This clarification recently was confirmed by the membership services staff, but has not been widely known or adhered to as numerous institutions have purchased videotapes of opponents from scouting services. Due to the time constraints that exist in the sports of men's and women's basketball and women's volleyball to prepare for opponents in the championship, it should be permissible to purchase videotapes from individuals or scouting services who have such tapes readily available to all institutions participating in the applicable championship. Such cost is minimal, and permitting the purchase of these tapes does not undermine the basic intent of the prohibition against in-person scouting by members of the coaching staff.
