ADMINISTRATIVE REGULATIONS -- FOREIGN TOURS AND COMPETITION -- ELIGIBILITY OF STUDENT-ATHLETES -- ONE TOUR LIMIT

Status: Defeated Final

Intent: To eliminate the once-in-four-years restriction on institutional foreign tours and to specify that a student-athlete shall not participate in more than one institutional foreign tour.

A.    Bylaws: Amend 30.7.2 by adding new 30.7.2.1, as follows:

"30.7.2 Eligibility of Student-Athletes. The eligibility of student-athletes on the tour shall be governed by the following (see Bylaw 14.2.3.6):

[30.7.2-(a) through 30.7.2-(b) unchanged.]

"30.7.2.1 One Tour Limitation.  A student-athlete shall not participate in more than one institutional foreign tour during his or her period of eligibility."

B.    Bylaws: Amend 30.7.4, as follows:

"30.7 FOREIGN TOURS AND COMPETITION

A member institution may participate in a foreign tour in any sport (see Bylaw 17.32), provided the conditions specified below are met.

[30.7.1 through 30.7.3 unchanged.]

"30.7.4 Time Lapse between Tours. An institution shall not engage in a foreign tour in each sport more than once every four years."

C.    Bylaws: Amend 17.2.5.4, as follows:

"17.2.5.4 Once-in-Four-Years Exemption -- Foreign Tour. The dates of competition on a foreign tour shall be excluded from the maximum number of dates of competition, provided the tour occurs only once in a four-year period and is conducted by the member institution in accordance with the procedures set forth in Bylaw 30.7 (see Bylaw 17.32)."

D.    Bylaws: Amend 17.3.5.4, as follows:

"17.3.5.4 Once-in-Four-Years Exemption -- Foreign Tour.  The dates of competition on a foreign tour shall be excluded from the maximum number of dates of competition, provided the tour occurs only once in a four-year period and is conducted by the member institution in accordance with the procedures set forth in Bylaw 30.7 (see Bylaw 17.32)."

E.    Bylaws: Amend 17.14.5.5, as follows:

"17.4.5.5 Once-in-Four-Years Exemption -- Foreign Tour.  An institution may exempt the contests played on a foreign tour, provided the tour is conducted by the member institution in accordance with the procedures set forth in Bylaw 30.7 (see Bylaw 17.32). An institution may not use this exemption in the same year that it uses an exemption set forth in Bylaw 17.14.5.4."

F.    Bylaws: Amend 17.6.5.4, as follows:

"17.6.5.4 Foreign Tour.  The dates of competition on a foreign tour shall be excluded from the maximum number of dates of competition, provided the tour occurs only once in a four-year period and is conducted by the member institution in accordance with the procedures set forth in Bylaw 30.7 (see Bylaw 17.32)."

G.    Bylaws: Amend 17.7.5.5, as follows:

"17.7.5.5 Once-in-Four-Years Exemption -- Foreign Tour.  An institution may exempt the contests played on a foreign tour, provided the tour is conducted by the member institution in accordance with the procedures set forth in Bylaw 30.7 (see Bylaw 17.32). An institution may not use this exemption in the same year that it uses an exemption set forth in Bylaw 17.7.5.4."

H.    Bylaws: Amend 17.8.5.4, as follows:

"17.8.5.4 Foreign Tour.  The dates of competition in equestrian on a foreign tour shall be excluded from the maximum number of dates of competition, provided the tour occurs only once in a four-year period and is conducted by the member institution in accordance with the procedures set forth in Bylaw 30.7 (see Bylaw 17.32)."

I.    Bylaws: Amend 17.9.5.4, as follows:

"17.9.5.4 Once-in-Four-Years Exemption -- Foreign Tour.  An institution may exempt the contests played on a foreign tour, provided the tour is conducted by the member institution in accordance with the procedures set forth in Bylaw 30.7 (also see Bylaw 17.32).  An institution may not use this exemption in the same year that it uses an exemption set forth in Bylaw 17.9.5.3."

J.    Bylaws: Amend 17.10.5.5, as follows:

"17.10.5.5 Once-in-Four-Years Exemption -- Foreign Tour.  An institution may exempt the contests played on a foreign tour, provided the tour is conducted by the member institution in accordance with the procedures set forth in Bylaw 30.7 (see Bylaw 17.32). An institution may not use this exemption in the same year that it uses an exemption set forth in Bylaw 17.10.5.4."

K.    Bylaws: Amend 17.11.5.2, as follows:

"17.11.5.2. Annual Exemptions.  The maximum number of football contests shall exclude the following:

[17.11.5.2-(a) through 17.11.5.2-(i) unchanged.]

"(j) Foreign Tour. The football games played on a foreign tour, provided the tour occurs only once in a four-year period and is conducted by the member institution in accordance with the procedures set forth in Bylaw 30.7 (see Bylaw 17.32);"

[17.11.5.2-(k) through 17.1.5.2-(l) unchanged.]

L.    Bylaws: Amend 17.12.5.4, as follows:

"17.12.5.4 Once-in-Four-Years Exemption -- Foreign Tour. An institution may exempt a foreign tour from its maximum number of dates of competition, provided the tour occurs only once in a four-year period and is conducted by the member institution in accordance with the procedures set forth in Bylaw 30.7 (see Bylaw 17.32). An institution may not use this exemption in the same year that it uses an exemption set forth in Bylaw 17.12.5.3."

M.    Bylaws: Amend 17.13.5.4, as follows:

"17.13.5.4 Once-in-Four-Years Exemption -- Foreign Tour.  The contests played on a foreign tour, provided the tour is conducted by the member institution in accordance with the procedures set forth in Bylaw 30.7 (see Bylaw 17.32). An institution may not use this exemption in the same year that it uses an exemption set forth in Bylaw 17.13.5.3."

N.    Bylaws: Amend 17.14.5.5, as follows:

"17.14.5.5 Once-in-Four-Years Exemption -- Foreign Tour.  An institution may exempt the contests played on a foreign tour, provided the tour is conducted by the member institution in accordance with the procedures set forth in Bylaw 30.7 (see Bylaw 17.32).  An institution may not use this exemption in the same year that it uses an exemption set forth in Bylaw 17.14.5.4."

O.    Bylaws: Amend 17.15.5.5, as follows:

"17.15.5.5 Once-in-Four-Years Exemption -- Foreign Tour.  An institution may exempt the contests played on a foreign tour, provided the tour is conducted by the member institution in accordance with the procedures set forth in Bylaw 30.7 (see Bylaw 17.32).  An institution may not use this exemption in the same year that it uses an exemption set forth in Bylaw 17.15.5.4."

P.    Bylaws: Amend 17.16.5.5, as follows:

"17.16.5.5 Once-in-Four-Years Exemption -- Foreign Tour.  An institution may exempt the contests played on a foreign tour, provided the tour is conducted by the member institution in accordance with the procedures set forth in Bylaw 30.7 (see Bylaw 17.32). An institution may not use this exemption in the same year that it uses an exemption set forth in Bylaw 17.16.5.4."

Q.    Bylaws: Amend 17.17.5.4, as follows:

"17.17.5.4 Foreign Tour.  The dates of competition in rowing on a foreign tour shall be excluded from the maximum number of dates of competition, provided the tour occurs only once in a four-year period and is conducted by the member institution in accordance with the procedures set forth in Bylaw 30.7 (see Bylaw 17.32)."

R.    Bylaws: Amend 17.18.5.4, as follows:

"17.18.5.4 Foreign Tour.  An institution may exempt the contests played on a foreign tour, provided the tour occurs only once in a four-year period and is conducted by the member institution in accordance with the procedures set forth in Bylaw 30.7 (see Bylaw 17.32)."

S.    Bylaws: Amend 17.19.5.5, as follows:

"17.19.5.5 Once-in-Four-Years Exemption -- Foreign Tour.  An institution may exempt the contests played on a foreign tour, provided the tour is conducted by the member institution in accordance with the procedures set forth in Bylaw 30.7 (see Bylaw 17.32).  An institution may not use this exemption in the same year that it uses an exemption set forth in Bylaw 17.19.5.4."

T.    Bylaws: Amend 17.20.5.5, as follows:

"17.20.5.5 Once-in-Four-Years Exemption -- Foreign Tour.  An institution may exempt the contests played on a foreign tour, provided the tour is conducted by the member institution in accordance with the procedures set forth in Bylaw 30.7 (see Bylaw 17.32).  An institution may not use this exemption in the same year that it uses an exemption set forth in Bylaw 17.20.5.4."

U.    Bylaws: Amend 17.21.5.5, as follows:

"17.21.5.5 Once-in-Four-Years Exemption -- Foreign Tour.  An institution may exempt those softball games played on a foreign tour, provided the tour is conducted by the member institution in accordance with the procedures set forth in Bylaw 30.7 (see Bylaw 17.32), from its maximum number of softball contests during any academic year.  An institution may not use this exemption in the same year that it uses an exemption set forth in Bylaw 17.21.5.4."

V.    Bylaws: Amend 17.22.5.4, as follows:

"17.22.5.4 Once-in-Four-Years Exemption -- Foreign Tour.  An institution may exempt the dates of competition on a foreign tour, provided the tour occurs only once in a four-year period and is conducted by the member institution in accordance with the procedures set forth in Bylaw 30.7 (see Bylaw 17.32)."

W.    Bylaws: Amend 17.23.5.5, as follows:

"17.23.5.5 Once-in-Four-Years Exemption -- Foreign Tour.  An institution may exempt the contests played on a foreign tour, provided the tour is conducted by the member institution in accordance with the procedures set forth in Bylaw 30.7  (see Bylaw 17.32).  An institution may not use this exemption in the same year that it uses an exemption set forth in Bylaw 17.23.5.4."

X.    Bylaws: Amend 17.24.5.4, as follows:

"17.24.5.4 Once-in-Four-Years Exemption -- Foreign Tour. An institution may exempt the dates of competition on a foreign tour, provided the tour occurs only once in a four-year period and is conducted by the member institution in accordance with the procedures set forth in Bylaw 30.7 (see Bylaw 17.32)."

Y.    Bylaws: Amend 17.25.5.4, as follows:

"17.25.5.4 Once-in-Four-Years Exemption -- Foreign Tour.  An institution may exempt the dates of competition on a foreign tour, provided the tour occurs only once in a four-year period and is conducted by the member institution in accordance with the procedures set forth in Bylaw 30.7 (see Bylaw 17.32)."

Z.    Bylaws: Amend 17.26.5.5, as follows:

"17.26.5.5 Once-in-Four-Years Exemptions -- Certification Not Required -- Foreign Tour.  An institution may exempt the contests played on a foreign tour, provided the tour is conducted by the member institution in accordance with the procedures set forth in Bylaw 30.7 (see Bylaw 17.32). An institution may not use this exemption in the same year that it uses an exemption set forth in Bylaw 17.26.5.4."

AA.   Bylaws: Amend 17.27.5.5, as follows:

"17.27.5.5 Once-in-Four-Years Exemption -- Foreign Tour. An institution may exempt the contests played on a foreign tour, provided the tour is conducted by the member institution in accordance with the procedures set forth in Bylaw 30.7 (see Bylaw 17.32)."

BB.   Bylaws: Amend 17.28.11, as follows:

"17.28.11 Once-in-Four-Years Exemption -- Foreign Tour.  An institution may not exempt more than one foreign tour from its maximum number of dates of competition in volleyball during any academic year and may not repeat participation in a foreign tour within a four-year period. The tour shall be conducted by the member institution in accordance with the procedures set forth in Bylaw 30.7 (see Bylaw 17.32).  An institution may not use this exemption in the same year that it uses an exemption set forth in Bylaw 17.28.10."

CC.   Bylaws: Amend 17.29.5.5, as follows:

"17.29.5.5 Once-in-Four-Years Exemption -- Foreign Tour -- Men and Women.  An institution may exempt the contests played on a foreign tour, provided the tour is conducted by the member institution in accordance with the procedures set forth in Bylaw 30.7 (see Bylaw 17.32). In men's water polo, an institution may not use this exemption in the same year that it uses an exemption set forth in Bylaw 17.29.5.4."

DD.   Bylaws: Amend 17.30.5.5, as follows:

"17.30.5.5 Once-in-Four-Years Exemption -- Foreign Tour.  An institution may exempt the contests played on a foreign tour, provided the tour is conducted by the member institution in accordance with the procedures set forth in Bylaw 30.7 (see Bylaw 17.32). An institution may not use this exemption in the same year that it uses an exemption set forth in Bylaw 17.30.5.4." 

EE.   Bylaws: Amend 17.32.2.1, as follows:

"17.32.2.1 Institutional Foreign-Tour Limitations.  A member institution shall be charged with its foreign-tour opportunity in a sport and its once-in-four-years limitation if the institution is represented by more than the number of student-athletes specified under Bylaw 17.32.2 on an outside team participating in a foreign tour in that sport."

Rationale: Under current legislation, foreign tours are permitted once every four years. The additional prohibition on conducting foreign tours immediately prior to the championship segment restricts tours for fall sports to the early summer. The difficulty fall sports encounter with early summer is that graduating seniors or student-athletes, who have exhausted their eligibility, although eligible to participate on the tour, are less likely to participate because they have progressed on to other parts of their lives. Additionally, the team has moved on to function without them. A foreign tour during winter break is possible; however, student-athletes are not able to spend time with their families. Many consider spring break too short to make a foreign tour worthwhile. Consequently, because of the once-in-four-years limitation on institutional foreign tours, one class of each fall sport may not have the opportunity to experience the competitive, educational and social opportunities associated with a foreign tour. This proposal would allow student-athletes to participate in one foreign tour during their intercollegiate career, thus ensuring that no fall sports student-athletes would miss out on this opportunity.
