Introduction and approval of a proposal in the Accelerated Legislative Process requires at least a two-thirds majority vote of the committee members present and voting. The Accelerated Legislative Process includes the following elements:

(1) Proposals approved by a committee in the specified time period will be presented to cabinet members electronically by five business days after the close of the applicable period. The cabinet will determine if the proposal should be adopted immediately (no cabinet action required) or if it should be discussed by the cabinet during its next meeting.
(2) Cabinet members have three business days to review. Unless at least 25% of cabinet members request to discuss the proposal, it is considered adopted and final at the end of the three-day period. A proposal adopted in this manner is not subject to the rescission process.

(d) Finality of Action. A proposal subject to review during a cabinet meeting that is adopted or defeated by the cabinet shall be considered final at the conclusion of the applicable cabinet meeting. The Board of Directors, during any meeting, may review and take emergency action related to legislation approved or defeated by a committee or the cabinet. The concept of a defeated proposal is not subject to a waiting period to be reintroduced into the legislative process.
(e) Rescission Process. A proposal subject to review during a cabinet meeting that is adopted with less than a 75 percent majority vote of the Cabinet members present and voting shall be subject to a 10-day rescission period. During a 14-day period, institutional SAAC presidents from active member institutions with voting privileges may provide their positions to either support or oppose the adoption of the proposal. Each institution may only provide one vote from one individual designated as its institutional SAAC president. If at least two-thirds of all active Division I institutional SAAC presidents who are eligible to vote support adoption, the Cabinet will reconsider its action. The Cabinet may reverse or uphold its previous action. The Division I Board of Directors may override any action taken.
(i) Rescission Process. A proposal adopted with less than a 75 percent majority vote of the Cabinet members present and voting is subject to a 30-day rescission period.

An amendment that pertains only to football shall be rescinded in the applicable subdivision upon submission of rescission requests from at least two-thirds of all active Football Bowl Subdivision or Football Championship Subdivision institutions, respectively.
9.2.2.3.3 Accelerated Legislative Process. If an authorized committee or the Cabinet or Board of Directors determines that consideration of a proposal in the standard legislative process would cause a disruption in the efficient administration of the impacted activity or function, it may introduce a proposal in the accelerated legislative process during any meeting. Introduction of a proposal in the accelerated process by an authorized committee other than the Cabinet or Board of Directors requires at least a two-thirds majority vote of the committee members present and voting. The Cabinet or Board of Directors may introduce a proposal into the accelerated legislative process during any meeting by a simple majority vote. The accelerated legislative process includes the following elements:
(a) Publication. Proposals are drafted as they are introduced and made available for review by five business days after the introduction. An announcement is posted when a proposal is available for review.
(b) Accelerated Cabinet Review. Proposals that are introduced in the accelerated legislative process are subject to accelerated review by the Cabinet. Proposals will be reviewed by the Cabinet up to two times per month. Proposals introduced in the first 15 days of a month will be grouped together for accelerated Cabinet review and proposals introduced and approved in the second half of a month (16th day through the end of the month) will be grouped together for accelerated Cabinet review.
(1) Proposals introduced by a committee in the specified time period will be presented to Cabinet members electronically for a vote during a period of three business days. The Cabinet may adopt the proposal (two-thirds majority required) or recommend the Cabinet discuss the proposal during its next meeting. If a proposal is requested to be discussed during the next Cabinet meeting, it will be added to the meeting agenda and will be subject to the options detailed in the Cabinet’s policies and procedures. Proposals in this process that are introduced by a Football Oversight Committee and applicable only to football will be reviewed by only the Cabinet members that represent the applicable subdivision (FBS or FCS).
(c) Finality of Action. A proposal that is adopted or defeated by the Cabinet shall be considered final at the conclusion of the applicable Cabinet meeting. The Board of Directors, during any meeting, may review and take emergency action related to legislation adopted or defeated by the Cabinet. The concept of a defeated proposal is not subject to a waiting period to be reintroduced into the legislative process.
(d) Rescission Process. A proposal adopted with less than a 75 percent majority vote of the Cabinet members present and voting shall be subject to a 10-day rescission period.

(2) Submission of Rescission Requests. A rescission request may be submitted by an active member institution with voting privileges. A request must be received in the national office not later than 5 p.m. Eastern time within 10 days of the date of the Cabinet meeting on which the adoption becomes final. A request must be approved by the institution's chancellor or president. The institution's chancellor or president or a designated representative may submit the rescission request to the national office.
(3) Threshold for Rescission. An amendment shall be rescinded upon submission of rescission requests from at least two-thirds of all active Division I institutions. An amendment that pertains only to football shall be rescinded in the applicable subdivision upon submission of rescission requests from at least two-thirds of all active Football Bowl Subdivision or Football Championship Subdivision institutions, respectively.
9.2.2.4 Emergency Legislation. The Board of Directors or the Cabinet may adopt emergency legislation during any meeting. A proposal may be considered as emergency legislation in circumstances in which significant values are at stake and the use of the regular legislative process is likely to cause significant harm or hardship to the Association or the Division I membership because of a delay in considering the proposal in the standard legislative cycle or accelerated legislative process. Adoption of emergency legislation requires two separate votes of at least an 80% majority of members of the applicable entity present and voting. The first vote is to determine whether the proposal meets the definition of emergency legislation and the second vote is on the merits of the proposal. A proposal adopted as emergency legislation shall be considered final at the conclusion of the meeting during which it is adopted. The Board of Directors, during any meeting, may review and take action related to legislation adopted or defeated by the Cabinet. A proposal adopted as emergency legislation is not subject to a rescission process.
9.2.2.5 Recording and Reporting Legislative Votes. A legislative vote taken by a committee with legislative authority shall be recorded and reported to the membership. The report shall include a record of each committee member's vote.

Source: NCAA Division I Cabinet
Effective Date:Immediate
Proposal Category: Amendment
Topical Area: Legislative Authority and Process
Rationale: In its final report, the NCAA Division I Decision-Making Working Group referred to the Division I Cabinet the development of the legislative processes necessary to support the new Division I governance structure. Since December 2025, the NCAA Division I Cabinet Legislative Processes Subgroup has assessed the pilot processes, which have been used since 2023-24 and were designed for a structure that includes sports oversight committees, and has developed several enhancements to further promote efficient decision-making. The subgroup's recommendations maintain several components of the legislative pilot processes, including the limited authority of sports oversight committees, and incorporate elements intended to increase efficiency and effectiveness, including limited authority for other committees and the use of accelerated processes when appropriate. In addition, this proposal would remove formulas for the recruiting calendars from the legislation and they would be handled as matters of policy. Sports oversight committees would have the authority to approve changes to recruiting calendars as a matter of policy instead of going through the legislative process. Recruiting calendars would be presented in the NCAA Division I Manual in LSDBi as visual illustrations instead of legislated language. The legislative language would be maintained in the policies and procedures of the sports oversight committees. Engaging in recruiting activities at an impermissible time will remain a violation of the appropriate subsection of Bylaw 13.
Division I Commitment addressed by proposal: The Commitment to Value-Based Legislation.
Is the proposal consequential or nationally significant?: Yes. The Division I legislative processes are nationally significant.
Is the proposal enforceable and how do the merits outweigh monitoring burdens?: This proposal does not include a monitoring burden.
How does the proposal support student-athlete success/well-being?: This proposal supports student-athlete success by increasing efficiencies to effectuate legislative changes to potentially benefit student-athletes and by permitting the Division I Student-Athlete Advocacy Committee to introduce proposals in areas that directly impact student-athletes.
Estimated Budget Impact: None.
Impact on Student-Athlete's Time (Academic and/or Athletics): None.
