ATHLETICS PERSONNEL -- ELIMINATION OF ENDORSEMENT RESTRICTIONS

Status: Adopted Final

Intent: To eliminate restrictions on endorsement of specific entities and individuals associated with prospective student-athletes.

Bylaws: Amend 11.3, as follows:

11.3 Compensation and Remuneration.

11.3.2 Income in Addition to Institutional Salary.

[11.3.2.1 through 11.3.2.3 unchanged.]

11.3.2.4 Noninstitutional Publications That Report on Athletics Program. Athletics department staff members shall not endorse (either orally or in writing) any noninstitutional publication dedicated primarily to reporting on an institution's athletics activities, except as provided in this section, and shall not write for such publications.

11.3.2.4.1 Educational Articles. Athletics department staff members may write educational articles related to NCAA rules and crowd control for noninstitutional publications dedicated primarily to reporting on an institution's athletics activities.

11.3.2.54 Recruiting Service Consultants. Institutional athletics department staff members may not endorse, serve as consultants or participate on advisory panels for any recruiting or scouting service involving prospective student-athletes.

11.3.2.6 Quotations and Pictures Used to Promote a Camp. An institution's coaching staff member may not promote a noninstitutional camp or clinic by permitting the use of quotations and/or pictures in the camp or clinic brochure, unless that coaching staff member is employed by the camp.

11.3.2.75 Consultant for or Endorsement of Noninstitutional Athletics Events Involving Prospective Student-Athletes. An athletics department staff member may not serve as a consultant for a noninstitutional athletics event that primarily involves prospective student-athletes and may not endorse or promote such an event.

11.3.2.7.1 Exception -- Actions That Indicate Approval of Content on Social Media Platforms. An athletics department staff member may take actions (e.g., "like," "favorite," republish, etc.) on social media platforms that indicate approval of content on social media platforms that was generated by users of the platforms other than institutional staff members or representatives of an institution's athletics interests. (See Bylaw 11.3.2.5.)

11.3.2.8 Promotion or Endorsement of a Prospective Student-Athlete's Team, Coach or Athletics Facility. An athletics department staff member shall not promote or endorse a prospective student-athlete's team or coach, or an athletics facility that is primarily used by prospective student-athletes.

11.3.2.8.1 Exception -- Actions That Indicate Approval of Content on Social Media Platforms. An athletics department staff member may take actions (e.g., "like," "favorite," republish, etc.) on social media platforms that indicate approval of content on social media platforms that was generated by users of the platforms other than institutional staff members or representatives of an institution's athletics interests. (See Bylaw 11.3.2.5.)

Rationale: The Board of Directors Infractions Process Committee requested that the Legislative Committee Modernization of the Rules Subcommittee focus its rules modernization efforts on identifying rules that no longer serve the needs of the membership and the 21st century student-athlete, and recommending modifications to or the elimination of such rules. Specifically, the subcommittee is focusing its review on rules that are outdated and rules for which the utility of national oversight is outweighed by the monitoring and enforcement burden. In the rapidly evolving digital age, the minimal recruiting advantage gained by endorsing individuals or entities associated with prospective student-athletes is significantly outweighed by the monitoring burden of ensuring compliance with the legislation. General publicity restrictions regarding the recruitment of specific student-athletes would remain in place to deter material recruiting advantages.
