ACADEMIC ELIGIBILITY -- EXCEPTIONS FOR TRANSFERS FROM FOUR-YEAR COLLEGES -- HEAD COACH DEPARTURE PRIOR TO INITIAL FULL-TIME ENROLLMENT EXCEPTION

Status: Adopted Final

Intent: To establish an exception to the transfer residence requirement for a student who transfers to the certifying institution from another four-year institution and the following conditions are met: (1) At the time of transfer to the certifying institution the student-athlete had not begun initial full-time collegiate enrollment; and (2) The former head coach at the student's previous institution departed after the student met a condition affecting transfer status and before the start of the next regular academic term.

Bylaws: Amend 14.5.5.2, as follows:

14.5.5.2 Exceptions for Transfers From Four-Year Colleges. A transfer student (other than one under disciplinary suspension per Bylaw 14.5.1.2) from a four-year collegiate institution is not subject to the residence requirement for intercollegiate competition, provided the student does not have an unfulfilled residence requirement at the institution from which he or she is transferring (except for the return to original institution without participation or with minimal participation exception) and any of the following exceptions is satisfied. During the student-athlete's first academic year of full-time collegiate enrollment, such conditions may serve as a basis for an exception to the residence requirement only for transfer students who, at the time of initial collegiate enrollment, met the requirements for qualifiers (set forth in Bylaw 14.3.1) in Division I.

14.5.5.2.11 Head Coach Departure Prior to Initial Full-Time Enrollment Exception. The student transfers to the certifying institution from another four-year institution and the following conditions are met:

(a) The student has not previously enrolled as a full-time student in a regular term (semester or quarter) of a collegiate institution (see Bylaw 12.8.1.1); and

(b) The head coach at the student's previous institution left the institution after the student met a condition affecting transfer status (see Bylaw 14.5.2) and before the start of the next regular academic term (e.g., fall semester).

Effective Date:August 1, 2019; applicable to a student-athlete who initially enrolls full-time at the certifying institution on or after August 1, 2019.

Rationale: Currently, an incoming student-athlete who receives athletics aid to attend summer school or engages in preseason practice activities triggers transfer status regardless of whether he or she initially enrolls full-time during the fall term. Establishing a four-year transfer exception for a student-athlete who enrolls at an institution for the first time during the summer, and whose head coach subsequently departs before the start of the fall term is fair and promotes student-athlete well-being. The head coach is a major variable in the recruitment process and the choice a student-athlete makes regarding where to attend college and participate in athletics. The student-athlete's academic certification (i.e., qualifier status) would continue to determine his or her eligibility for competition during their first year of enrollment following transfer to a new four-year institution.
