Intent: To specify that institutional financial aid based in any degree on athletics ability may be reduced or canceled during the period of the award or reduced or not renewed for the following academic year or years of the student-athlete's five-year period of eligibility if the recipient provides written notification of transfer to the institution; however, the student-athlete's financial aid may not be reduced or canceled until the end of the regular academic term in which written notification of transfer is received.
Bylaws: Amend 15.3.5, as follows:
15.3.5 Reduction, Cancellation or Nonrenewal of Institutional Financial Aid.
15.3.5.1 Reduction, Cancellation or Nonrenewal Permitted. Institutional financial aid based in any degree on athletics ability may be reduced or canceled during the period of the award or reduced or not renewed for the following academic year or years of the student-athlete's five-year period of eligibility if the recipient:

(d) Voluntarily (on his or her own initiative) withdraws from a sport at any time for personal reasons; however, the recipient's financial aid may not be awarded to another student-athlete in the academic term in which the aid is reduced or canceled. A student-athlete's request for written permission to contact another four-year collegiate institution regarding a possible transfer does not constitute a voluntary withdrawal; or
(e) Violates a nonathletically related condition outlined in the financial aid agreement or violates a documented institutional rule or policy (e.g., academics policies or standards, athletics department or team rules or policies); or
(f) Provides written notification of transfer (see Bylaw 13.1.1.3) to the institution; however, the student-athlete’s financial aid may not be reduced or canceled until the end of the regular academic term in which written notification of transfer is received. If a student-athlete provides written notification of transfer to the institution between regular academic terms (winter break, summer break) the institution may reduce or cancel the financial aid immediately.

Rationale: Pursuant to the potential notification of transfer model, a student-athlete would have more flexibility to determine a transfer destination and would be eligible to receive athletically related financial aid at a new institution in accordance with rules applicable to all students. This amount of flexibility could increase uncertainty for an institution from which a student-athlete is considering a transfer. Such an institution should be permitted to address roster issues and team dynamics and needs to have an opportunity to make those decisions at its discretion once written notification of transfer is provided. In addition, it is recognized that fairness to and the well-being of the student-athletes who remain at their institutions need to be considered along with fairness to and the well-being of student-athletes who decide to transfer. To balance these interests, each institution is provided the discretion to define its policies regarding a student-athlete's athletically related financial aid after providing written notification of transfer. These policies may include how long an institution has to make a decision whether to reduce, cancel or non-renew a student-athlete's athletically related financial aid (e.g., no decisions made until 14 days after notification of transfer received). However, at a minimum, athletically related financial aid may not be reduced or canceled until the end of the regular academic term in which notification is provided. If a student-athlete provides written notification of transfer between regular academic terms (winter break, summer break) the institution may reduce or cancel the financial aid immediately, subject to the hearing opportunity per Bylaw 15.3.5.1.1.
