Quincy University

Pursuant to Bylaw 19.10.6, this negotiated resolution has no precedential value. The agreed-upon violations in the negotiated resolution (NR) involved improper certification in multiple sport programs at Quincy University, which resulted at least in part from the institution’s failure to monitor its eligibility certification process. With respect to certification, the parties agreed that during the 2021-22 through 2023-24 academic years, Zerbe and the institution improperly certified 121 student-athletes across 17 sports as eligible for competition. As a result of the improper certifications, 93 student-athletes practiced beyond the 45-day period, 78 competed and received expenses while ineligible or not certified, and 26 received financial aid and expenses while ineligible or not certified. Additionally, Quincy failed to withhold 27 of these student-athletes from competition before their eligibility was reinstated.

The COI approved the parties’ agreed-upon penalties for Quincy, which included two years of probation, a $5,000 fine, vacation of team and individual records, an outside audit and required attendance at an NCAA Regional Rules Seminar. For Zerbe, the COI approved a two-year show-cause order. Any institution employing Zerbe during the show-cause period must restrict her from all athletically related activity during the first year and from all eligibility certification responsibilities during the second year.
